Welcome to TuitionMatch.org (the "Site"), operated by TSG, LLC, doing business as TuitionMatch ("Company", "we", "us", or "our").

By accessing or using this Site, you agree to be bound by these Terms of Use ("Terms") and our Privacy Policy. If you do not agree to these Terms, please do not use the Site.

1. DESCRIPTION OF SERVICES

TuitionMatch is a private placement agency and marketing company. We are not a government agency, a Department of Education entity, or a grantor of funds.

Our services are limited to:

  • Providing information about vocational training and potential funding sources (e.g., WIOA, TAA).
  • Connecting interested users with third-party education providers ("Education Partners") and placement specialists.
  • Assisting with the intake and pre-qualification process for training programs.

We do not guarantee that you will be approved for any specific grant, scholarship, voucher, or financial aid. Final funding decisions are made solely by state workforce boards or the respective Education Partners.

2. USER ELIGIBILITY & CONDUCT

By using this Site, you represent and warrant that:

  • You are at least 18 years of age.
  • You are a resident of the United States.
  • All information you submit via our forms (including income, employment status, and contact info) is truthful and accurate.

You agree not to:

  • Use the Site for any fraudulent or unlawful purpose.
  • Submit false or misleading information to qualify for funding.
  • Use any bot, spider, or automated means to access the Site or submit forms.

3. CONSENT TO CONTACT (TCPA DISCLOSURE)

PLEASE READ THIS SECTION CAREFULLY. BY SUBMITTING YOUR TELEPHONE NUMBER, YOU ARE AGREEING TO RECEIVE CALLS AND TEXT MESSAGES.

By entering your telephone number and clicking "Submit," "View Results," or similar buttons on our Site, you provide your express written consent for TSG, LLC (d/b/a TuitionMatch) and its Education Partners to contact you as follows:

  • Methods: You agree to receive telephone calls, text messages (SMS/MMS), and prerecorded or artificial voice messages.
  • Technology: You acknowledge and agree that these communications may be generated using an automatic telephone dialing system (ATDS) or other automated technology.
  • Frequency: Message frequency varies based on your interaction with our placement team. You may receive up to 15 messages per month.
  • Do Not Call Registry: You agree to receive these communications even if your telephone number is listed on any federal, state, or internal Do-Not-Call registry.
  • No Purchase Required: Consent is not a condition of any purchase, enrollment, or service.
  • Carrier Fees: Message and data rates may apply.

How to Opt Out

You may revoke your consent at any time by:

  • Replying STOP to any text message, or
  • Emailing support@tuitionmatch.org with the subject line "Opt-Out Request," or
  • Calling (469) 608-1489 and requesting placement on our internal Do-Not-Call list.

4. NO GUARANTEE OF RESULTS OR EMPLOYMENT

Funding: References to "Free Training," "Vouchers," or "Scholarships" refer to potential eligibility for third-party funding programs (such as WIOA). We do not guarantee you will receive these funds.

Employment: We and our Education Partners may offer "Job Placement Assistance." This is not a guarantee of employment. We cannot promise a specific salary, job title, or hiring outcome upon graduation.

5. INTELLECTUAL PROPERTY

All content on this Site—including text, graphics, logos, and software—is the property of TSG, LLC or its licensors and is protected by copyright and trademark laws. You may not reproduce, distribute, or create derivative works from our content without express written permission.

6. THIRD-PARTY LINKS & PARTNERS

Our Site may contain links to third-party websites or services (including those of Education Partners). We do not control and are not responsible for the content, privacy policies, or practices of any third-party site. You acknowledge that your dealings with any Education Partner found through our Site are solely between you and that partner.

7. DISCLAIMER OF WARRANTIES

THE SITE AND SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TSG, LLC DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE ERROR-FREE, SECURE, OR UNINTERRUPTED.

8. LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY LAW, TSG, LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUE, ARISING OUT OF YOUR USE OF THE SITE OR YOUR RELATIONSHIP WITH ANY EDUCATION PARTNER, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED ONE HUNDRED DOLLARS ($100).

9. INDEMNIFICATION

You agree to defend, indemnify, and hold harmless TSG, LLC, its officers, directors, employees, agents, and partners from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to: (a) your violation of these Terms; (b) your use of the Site; (c) any information you submit through the Site; or (d) your violation of any rights of a third party.

10. DISPUTE RESOLUTION (ARBITRATION AGREEMENT & CLASS ACTION WAIVER)

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT AND TO HAVE A JURY HEAR YOUR CLAIMS.

A. Agreement to Arbitrate

You and TSG, LLC agree that any dispute, claim, or controversy arising out of or relating to these Terms, the Site, our services, or any communications you receive from us or our Education Partners (including disputes arising from or relating to the interpretation or application of this arbitration provision, but excluding disputes relating to the enforcement of the Class Action Waiver below) shall be resolved exclusively through final and binding individual arbitration rather than in court.

B. Arbitration Rules and Procedures

  • Arbitration Administrator: Arbitration will be administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules, available at www.adr.org.
  • Location: Arbitration will take place in the county of your residence or, at your election, by telephone or video conference.
  • Arbitration Fees: TSG, LLC will pay all AAA filing fees and arbitrator costs for claims under $25,000 (unless the arbitrator determines your claims are frivolous). You are responsible for your own attorneys' fees unless the arbitrator awards them to you.
  • Governing Rules: The arbitrator shall apply applicable substantive law consistent with the Federal Arbitration Act (9 U.S.C. §§ 1-16) and applicable statutes of limitations.

C. Class Action Waiver

YOU AND TSG, LLC AGREE THAT EACH PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, OR REPRESENTATIVE PROCEEDING.

If this class action waiver is found to be unenforceable, then the entirety of this arbitration provision shall be null and void, and all disputes shall proceed in court.

D. Opt-Out Right

You may opt out of this Arbitration Agreement by sending written notice to support@tuitionmatch.org within thirty (30) days of your first use of the Site. Your notice must include your name, address, phone number, and a clear statement that you wish to opt out of arbitration. If you opt out, you may pursue claims in court, but the Class Action Waiver shall still apply to the fullest extent permitted by law.

E. Survival

This arbitration provision shall survive the termination of these Terms and your use of the Site.

11. GOVERNING LAW

These Terms and any dispute arising out of or related to them or the Site shall be governed by and construed in accordance with the laws of the State of Colorado, without regard to its conflict of law provisions, except to the extent preempted by the Federal Arbitration Act.

12. SEVERABILITY

If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.

13. ENTIRE AGREEMENT

These Terms, together with our Privacy Policy, constitute the entire agreement between you and TSG, LLC regarding your use of the Site and supersede all prior agreements and understandings.
